A Live Streamed Virtual Workshop

Jaiya Inc. (referred to in this document also as “we”, “us,” “the company,”) is a professional company offering cutting edge practices to improve our client’s sex lives and partnerships. Our offerings may effect all aspects of our client’s lives.

Nature of Relationship:

Jaiya, Inc and its staff offer wellness and educational services. The program sessions provide training and intimacy skills for yourself and/or relationship and are not medical, financial, legal, or counseling advice.

You acknowledge that Jaiya Inc does not guarantee your ability to achieve a specific outcome from Your Path to Passion, Erotic Blueprint Breakthrough Course™, Ignite Your Passion program, the one-on-one coaching sessions, classes or events.. Each person has different awareness, skills and work ethic, and your level of participation along with factors outside the control of Jaiya Inc and its staff will impact your level of success from this program.

You attest that you are of sound body and mind. You are 100% personally responsible for your own mental and physical well being. If you are under the care of any health care professionals, whether for psychiatric, emotional, physical or other forms of care, we advise you to discuss your attendance at this event with your mental health professional before participating in the Program and get their permission to attend.

You will be asked to participate in discussions, mental and physical exercises, partnered and group practices which may be triggering to you emotionally or physically. You are participating in this workshop at your own risk. We have systems in place during the event to support participants of Path to Passion when challenging situations arise, however you are solely responsible for your own physical, emotional and psychological well being before, during and after the Path to Passion event. Especially given the nature of this online presentation, we have no ability to control your environment and no ability to ascertain your fitness to attend this event. You should take all precautions to have local support available to you should you become triggered or have a negative physical response due to your participation with any of the content included in or the practices suggested during the workshop. You are fully at choice to participate or not in any and all aspects of this workshop. Jaiya, Inc., it’s officers, support staff, the Blueprint Coaches, any of our affiliated companies or team and other participants are not responsible for your actions as they are related to this event or your reactions to any of what is presented as part of Path to Passion. You must be 18 years old or older to participate in any programs offered by Jaiya, Inc.

Required for your participation in the Path to Passion Live 2020, Live Streamed, Virtual Workshop:

EVERY PARTICIPANT MUST HAVE THEIR OWN ‘VIRTUAL TICKET’ (REGISTRATION AND LOGIN DETAILS) TO PARTICIPATE IN THE EVENT! During the event we will be splitting up into small breakout rooms to workshop elements of the teachings. You will need to be on your own individual zoom link so you can be set up in these Zoom breakout rooms with one or more other participants. For this reason, if you are attending as a couple, YOU BOTH NEED YOUR OWN INDIVIDUAL ZOOM LOGIN ACCESS TO THE EVENT.
Couples are not guaranteed to be in the same Zoom rooms during the event. The main instruction during the event will be viewed by everyone attending the event. To create intimacy during the event, you will be broken out into 100 person or less Zoom rooms lead by our Blueprint Coaches. It is in these 100 person Zoom rooms that you may not be in the same room as your partner. This is a good thing! We hope to create expansion for you by partnering with attendees other than your romantic partners in these breakout rooms. There will be no nudity during this event. The subject matter is racy but we handle this topic with sophistication and tact. We can’t promise you won’t be triggered, but we consider this event a PG-13 event visually. Our language will cross over into NC-17 but we do not force you to do anything you do not give consent to doing. We are a consent based community, so you will always have the ability to say “No”. We request that you play full out and dive into the exercises we will be guiding and we assume you are coming to this event with the intention of exploring and expanding in your sexuality. You can, of course, be in the same room with your partner in your home throughout the event. You may need to move to separate physical rooms when sent into breakout rooms so your computer audio does not create echo or distortion. Don’t worry, this will all become clearer during the workshop. We’ve got you and we are cultivating a powerful learning experience for you.
You will need an internet connection with the ability to use the Zoom Application with sound and video. Your internet connection must be strong enough to live stream. Jaiya, Inc. is not responsible for technical difficulties having to do with your equipment, internet provider, signal strength or technological failures of the Zoom Application or the inability of Zoom to stream the workshop. Jaiya, Inc. is taking all efforts to make sure the technology is solid and capable of delivering the event via live stream, but many factors are out of the control of the Jaiya, Inc. team.
The best known browser for Zoom is Chrome. Please make sure your Zoom application is updated and your computer equipment can handle the bandwidth necessary to successfully stream this 3-Day virtual workshop. We will provide technical assistance during the workshop but may be limited in our abilities to solve any problems.
You will be required to keep your video camera on for most of this event. We require this so we know who is in the virtual room at all times. You will also be asked to have your camera off during certain portions of the event.
No harassment, bullying, unwanted salacious behavior, nudity will be considered acceptable during this event and we will expel any participants found to be in breach of our community agreements (you will be tested on our community agreements and you and all other participants will have agreed to abide by our community agreements before receiving login details for the event. See our Anti-Discriimation Policy to understand our company commitments in this regard.
You are not permitted to record any portion of this event in any format: audio, video, photography, screen capture or any other known or currently unknown format. You agree that you will not, under any circumstances record any portion of this online workshop. You agree to pay damages to any individual involved in any recordings made by you of this event in the amount of no less than, but not limited to, $10,000.00 per person whether that person or those persons were harmed or not by your actions. These damages are due to both the individual(s) harmed and to Jaiya, Inc.. You are liable for any fees that arise from any costs associated to litigation, restorative justice processes, settlements or any other fees that Jaiya, Inc., its representatives and/or affiliated companies incur due to your breach of this agreement. You are welcome to take extensive notes of the content presented during this workshop.
The materials presented at Path to Passion are copyrighted and trademarked materials and you may not repurpose them for any commercial use or represent these teachings and trainings as your own.

We request and encourage you to attend all sessions of the Path to Passion event. If you miss segments of the event you may miss vital portions of the trainings and not receive the full benefits of participation.

Due to the sensitive nature of some segments of this event, arriving late to a session may mean that you will not be permitted to enter the virtual room until that segment is completed. If you are not on time for any segment, you forfeit your right to attend that segment. We strive to create a safer space for all attendees and by agreeing to attend this event, you also agree that you will put your full commitment into attending all segments of the event.

There are inherent risks to participating in an online, virtual workshop. As a participant you willingly and voluntarily accept these risks:

Due to the virtual, online nature of this event Jaiya, Inc. cannot assure the privacy or digital safety of participants. We are taking all precautions available to us to make this digital environment as safe and protected as possible, but we are unable to control the behaviors of other participants who may use digital technologies to unlawfully enter this virtual workshop space and/or record elements of the workshop even though all participants are legally restricted from doing so.

You, as a participant, understand that there are inherent risks to participating in an online, streamed event and are voluntarily taking those risks. You will hold harmless Jaiya, Inc and all its affiliates and assigns should our event policies be disregarded by anyone who has gained access to this workshop or video files of this workshop at any time during or after the event.

Main Event Room: Jaiya, Inc. will record the Main Room of the event where our primary instruction takes place. Jaiya, Inc. reserves the right to use the recording of the main room for any purpose, including but not limited to digital product sales of the event, advertising, testimonials, etc. If you choose to volunteer for any on camera demonstrations, questions and answers, shares or any other on camera opportunities that are delivered in the Main Room, you agree to give Jaiya, Inc. unrestricted use of these recordings. You release any and all rights to restrict Jaiya, Inc.’s use of these recorded materials. See our Media Release for further details regarding these policies.

Coach Breakout Rooms: During the workshop you will be broken out into Coach Breakout Rooms of 100 participants or less. These rooms will be recorded as well, HOWEVER we are recording these rooms only for the purposes of quality control and training our Blueprint Coaches and for added safety of all our Coaches and Participants, should anything occur in these Coach Breakout rooms that we need to refer to at a later date.

Individual Breakout Rooms: During the event participants will be put into individual breakout rooms containing 2 to 10 or more other participants. These breakouts will be used to workshop elements of the teachings. These Individual Breakout rooms will NOT be recorded. It is vitally important that all participants adhere to our community agreements during the entire event, but abiding by these agreements inside these more intimate Individual Breakout Room spaces will be of particular importance. If you find yourself partnered with a participant(s) who is not adhering to our Community Agreements during the event, please reach out to our Event Care Team immediately to inform us of this person and their actions. We will address any such concerns as quickly as a Team Care Member is available to do so. Actions taken to address such concerns may be but are not limited to: Giving a warning to the offending party or possible immediate removal of the offending party from the event.

Required Documents to be completed and on file with Jaiya, Inc. prior to your attendance at the event:

In the weeks leading up to the workshop, you will receive the following documents for your completion and electronic signature.

In order to receive your event login details and to be admitted to the workshop, you must have completed, signed and submitted all of the following documents. Again, you will receive all of this documentation via email prior to the event and will be able to complete these documents electronically. Do NOT print the documents below and mail paper copies to Jaiya, Inc.

Media release
General Waiver and Workshop Release
A successfully completed questionnaire for our “Event Agreements: Setting an Empowering and Safer Container for Path to Passion 2020!” pre-event video training. This video training will be emailed to you in the weeks leading up to the event. It is required viewing and the questionnaire must be successfully completed and submitted to Jaiya, Inc. in order for you officially complete your registration process and receive your login details to access the event.
Failure to submit any of these documents before the event will mean that you will not be granted access to the event until these documents are submitted.

Purchased Event Ticket Cancellation and Refund Policy:

This policy is applicable to our virtual 2020 Path to Passion as well as our Live, In-Person versions of this workshop

Cancellation Refunds for full price or discounted ticket offers are at the sole discretion of Jaiya, Inc.. Up to $300.00 U.S. Dollars of any ticket price is considered your Non-Refundable Seat Reservation Deposit and there will be no refunds or transfers allowed for this portion of your ticket purchase after the 72 hour cancellation window has passed.

Up to 90 days prior to the event you can request a refund for the full value of your ticket purchase or seat deposit.

After the 90 day refund window has passed Jaiya, Inc., at its’ sole discretion, may grant a refund of the remaining portion of your ticket purchase price (less the $300.00). No refunds will be granted within 90 days of the start date of the event for which your seat is reserved.

Ticket Pricing and Seat Reservation Deposits are Per Person fees. Unless you have been given a “Free” seat, for each person attending there must be either a ticket purchased or a Seat Reservation Deposit placed.

Each person attending MUST BE REGISTERED FOR THE EVENT and have their own “ticket” or “registration tag” for the event and must have on file with Jaiya, Inc. a completed Media Release Form, General Waiver and Release Form and for “Path to Passion 2020 Virtual” a successfully completed questionnaire for our “Event Agreements: Setting an Empowering and Safer Container for Path to Passion 2020!” pre-event video training.

All event ticket sales are considered final and terms and conditions apply.

Regarding our LIVE, IN-PERSON events:

The following “Seat Reservation Deposit” information is NOT relevant for our Virtual Path to Passion October 2020 event. It may again be relevant for our 2021 Path to Passion event if we hold the 2021 event in person.

When we deliver this event live and in person, if you have been given a “free/complimentary” seat, we require a minimum, per person seat deposit to consider your seat reserved. Complimentary/Free Event Tickets require a ‘Seat Reservation Deposit’. This deposit ensures that we hold a seat for you and that you will attend the event.

Seat Reservation Deposits are returned/refunded to you when and only when you attend the event.

You will be permitted to cancel your reservation up to 90 days prior to the event. Seat deposit refunds will be granted within this 90 day window if the request is made within 72 hours of purchase. Otherwise, once we are within 90 days of the event, you will only receive a refund when you attend the event.

Once you place your deposit, it is non-transferable. You will not be able to transfer your seat deposit(s) to a future event or another person.

All cancellation requests must be in writing and delivered by email to Jaiya@MissJaiya.com (or post marked mail – see address at the bottom of this document). Voicemail and verbal correspondence do not constitute written notice of requests for reservation cancellations. Please allow 72 hours for a response. Your request will be noted as the time your email was originally sent. If the refund request falls within the allowed refund window, please allow 4 to 6 weeks for your deposit to be refunded.

Jaiya Inc. is a professional company offering cutting edge practices to improve our client’s sex lives and partnerships. We have implemented this Reservation Fee Policy in an effort to support our clients and create a clear policy regarding ticketing for this event. Because there are substantial costs associated with each registrant that accepts a Complimentary Ticket… we ask that each registrant be serious about studying what we offer & attending Your Path to Passion.
When you enroll in Path to Passion using a Complimentary/Free ticket offer, you will be charged the $300 per person seat reservation fee. When you attend the event, your reservation fee will be returned to you during the course of the event. You are agreeing to attend this event live or forfeit the $300 Reservation Fee should you NOT ATTEND the event for any reason.

It is your sole responsibility to make sure you fully understand these terms and conditions. Your click of terms and conditions box during your ticket registration process is your legal signature and your agreement to abide by these terms and conditions.

You will indemnify and hold Jaiya Inc. harmless from any obligation, cost claim, judgment, attorneys’ and legal fees, and attachments in any way connected with the services rendered under the terms of this Agreement. Any controversies arising out of the terms of this Agreement or its interpretation shall be settled in Colorado in accordance with the rules of the American Arbitration Association, and the judgment upon award may be entered in any court having jurisdiction thereof.

This Policy will be strictly enforced and your cooperation is greatly appreciated.

Jaiya Inc. Your Path to Passion Seat Reservation Cancellation and Refund Policy:

In all cases, you have a choice to pay the full price of Your Path to Passion or agree to the Reservation Fee as indicated in this document. By signing this agreement (clicking the Terms and Conditions box on your web order form constitutes your signature) you authorize your credit card to be charged the full amount of the offer you have selected. Regarding a seat reservation deposit, if for any reason you decide NOT to attend the event, Jaiya, Inc. will retain this fee as compensation for the abandoned seat you had reserved.

Please email all technological and logistical questions to jaiya@missjaiya.com. Do not post in the £rotic Freedom Club group to get logistical questions answered about Path to Passion. Writing to jaiya@missjaiya.com will ensure that your questions are seen by customer care and we can track them to make sure you are well taken care of.

Payment requirements for participation in any Jaiya, Inc offering:

You must use your own credit card or debit card and it is your responsibility to keep your billing information up to date and accurate for payments due to Jaiya, Inc. Fees, including but not limited to additional interest or processing fees, bank fees for insufficient funds fees, etc., may be passed on to you for failure to meet the terms of you payment contract.

You must provide a valid name and email address during registration. If you use aliases and will be using an alias during the event, you are responsible for informing our team of your use of an alias.

If you remove yourself from our mailing list at any time, you may miss vital communications having to do with your program participation. You are solely responsible for maintaining valid email contact information for you in our system. You are also responsible for checking your spam, promotion and/or junk folders for communications you receive from us. We are unable to control the functions of your email provider and how they manage the receipt of emails from us.

Highly Advisable: Place our email jaiya@missjaiya.com in your ‘preferred sender’ contact list and/or address book, and consistently train your inbox to receive our messages into your main folder, so you do not miss important updates and logistical communication from our company.

Defaults and Cancellation Policy:

72 Hour Cancellation: You may cancel this transaction without penalty or obligation by contacting Jaiya@missjaiya.com prior to midnight of the third business day after the date of this Agreement. (Note: Refunds may take approximately 4-6 weeks to post to your account.)

VIP or Coaching Program Offerings:

Beyond the 72 hour cancellation period detailed above, our VIP or Blueprint Coach™ Certification Programs offer no cancellation opportunity. Your payment or deposit is non-refundable and your guarantee of your commitment to the program and fulfilling your payment contract.

Regarding fees associated to your application to be admitted into our VIP of Coach Certification Program: In some cases we require an application deposit in order to review your application to assure you will be a good fit for our trainings. If you are not accepted into our trainings, your full deposit will be returned to you after we have determined that you have not been accepted into our program(s).

Termination:

Jaiya Inc reserves the right to cancel anyone out of any program for any reason it deems appropriate, such as if Jaiya, Inc believes that your behavior is harmful to or damaging to the reputation of our programs, instructors or support team or the reputation of any of our teachings or programs, including but not limited to: the Ignite Your Passion Program, Erotic Blueprint Breakthrough™ Course, Erotic Freedom Club, Erotic Blueprint Coach Certification Program, Sex Mastery Mentorship, Mastery Mentorship VIP Programs or any of our live events, or damaging to other participants. If Jaiya, Inc. determines that your needs are not well suited to any of our trainings for any reason, Jaiya, Inc reserves the right to terminate your involvement in the training, course or membership club. In such cases, there will be no refund.

Warranties:

You acknowledge that you are not relying upon any warranties, promises, guarantees or representations made by any member of the Jaiya, Inc. team, staff, Blueprint Coaches, affiliates or subsidiaries of Jaiya, Inc. or attendees of our workshops or trainings, or anyone acting or claiming to act on behalf of Jaiya, Inc and its subsidiaries unless such warranties have been made in writing and made a part of this Agreement.

This Agreement along with our Jaiya, Inc. privacy policy (http://yourpathtopassion.com/privacy/) and disclaimer (http://yourpathtopassion.com/disclaimer/) linked here contains the entire understanding and agreement between you and Jaiya, Inc, and no addition or modification of any terms shall be effective unless set forth in writing and signed by you and Jaiya, Inc..

RESTRICTIONS ON USE; LIMITED LICENSE:

All content contained on the Website (collectively, “Content”), such as text, graphics, logos, icons, images, audio and video clips, digital downloads, data compilations, and software, is our (Jaiya, Inc.) property or the property of our licensors or licensees, and the compilation of the Content on the Website is our exclusive property, protected by United States and international copyright laws, treaties and conventions. All software used on the Website is our property or the property of our software suppliers and protected by United States and international copyright laws, treaties and conventions.
Any trademarks, service marks, graphics, logos, page headers, icons, scripts and trade names (each, a “Mark”) contained on the Website are proprietary to us or our licensors or licensees. Our Marks may not be used in connection with any product or service that is not ours in any manner that is likely to cause confusion among users or that disparages or discredits us or anyone else. All other Marks not owned by us that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

We grant you a limited license to access and make personal use of the Website. No Content of the Website or any other Internet site owned, operated, licensed, or controlled by us may be copied, reproduced, republished, downloaded (other than page caching), uploaded, posted, transmitted or distributed in any way, or sold, resold, visited, or otherwise exploited for any commercial purpose, except that you may download one (1) copy of the Content that we make available to you for such purposes on a single computer for your personal, noncommercial, home use only, provided that you: (a) keep intact all copyright, trademark and other proprietary rights notices; (b) do not modify any of the Content; (c) do not use any Content in a manner that suggests an association with any of our products, services or brands; and (d) do not download Content so as to avoid future downloads from the Website. Amendment

We reserve the right, in our sole discretion, to change, modify, add or delete portions of these Terms and Conditions at any time without notice. Our best efforts will be made to notify you of changes to our policy, however it is your responsibility to review these Terms and Conditions for any changes. We make no guarantee of notification of changes to our Terms and Conditions Policies. Your use of our course offerings following any change to these Terms and Conditions will constitute your assent to and acceptance of the revised Terms of Use.

Indemnification:

You agree to indemnify and hold harmless Jaiya Inc as a result of your voluntary choice to participate in this program. You will not hold Jaiya Inc or its representatives responsible for any actions or adverse results created as a direct result of advice or recommendations given by Jaiya Inc, our support staff, The Blueprint Coaches, or other program participants.

Disputes:

Any and all unresolved disputes regarding this Agreement shall be settled by binding arbitration before a single arbitrator, using the Commercial Rules of the American Arbitration Association, Colorado. The laws of the State of Colorado shall govern this Agreement. If it becomes necessary to enforce this Agreement through legal action, then we shall be entitled to recover reasonable attorney fees and costs incurred in such enforcement of this Agreement.
